
New York State could collect $1.75 million in damages a month from the developers to provide affordable housing—but chooses not to.
On June 3, community leaders and elected officials marked the passing of Atlantic Yards’ May 2025 affordable housing deadline and demanded Governor Kathy Hochul collect liquidated damages for failing to complete 877 badly-needed affordable apartments. At $2,000 per month per apartment, the monthly payments of $1,754,000 were agreed as part of a community settlement in 2014 to create and preserve affordable housing that the project promised but hasn’t provided.
Two weeks later, even more elected officials wrote a letter to the Governor calling on her to collect the funds, pointing out they can be put to immediate use in rezoned areas near Atlantic Yards. But Governor Hochul’s Empire State Development has yet to ask for the money owed–which on July 1 grew to $3,508,000.
